Please read these Terms of Use (“Terms”) carefully before using the Platform.

If you live in certain countries or regions, additional terms may apply and are viewable at the bottom of these Terms. Where applicable, those additional terms override these Terms to the extent of any inconsistency.

Welcome to Zelus.com, operated by Zelus Sport Limited (registered in England and Wales under company number 10004967, registered office: Station House, Stamford New Road, Altrincham, United Kingdom, WA14 1EP). References to “Zelus”, “we”, “us” or “our” mean Zelus Sport Limited.

Zelus is the official teamwear licensee of Nike Inc and is authorised to use Nike logos, brands and symbols in the design, manufacture, distribution and sale of teamwear sports merchandising.

These Terms create a legally binding agreement between you and Zelus regarding your use of the Platform, which may be accessed through any device, including computers, mobile phones, tablets or other technology.

Changes to These Terms and the Platform

Some jurisdictions do not permit unilateral updates to consumer terms. Where permitted, we may update these Terms from time to time. If a material change is made, we will post a notice on the Platform or notify you directly. Continued use of the Platform after notification constitutes acceptance of the updated Terms, except where prohibited by law.

We may also update or change the Platform to reflect changes to our products, user needs or business priorities.

Privacy and Cookies

Our Privacy Policy describes how we collect and use personal information on the Platform and applies to your use of the Platform.

Eligibility and Ground Rules

Ownership of Platform Content

Except for User Content, all content available on the Platform (including text, software, code, designs, graphics, images, videos, music and other materials) is owned by Zelus or its licensors and is protected by intellectual property laws.

All trademarks, service marks and trade names, including Nike trademarks, are owned or licensed by Nike Inc or its affiliates. Your use of the Platform does not grant you any ownership or license rights in such intellectual property.

You may not remove or alter ownership notices from any materials accessed through the Platform.

Where Zelus permits access to copyrightable content, you are granted a limited, personal, non-transferable, non-sublicensable and revocable license to use such content solely for its intended purpose and for personal, non-commercial use only. Zelus may revoke this license at any time.

Any unauthorised use of Platform content may violate intellectual property laws and result in civil or criminal liability.

User Content and Posting Rules

Certain parts of the Platform allow you to submit content, including comments, questions or other materials (“User Content”). User Content remains owned by you or its creator, but by submitting it you grant Zelus a non-exclusive, perpetual, transferable, sub-licensable, royalty-free, worldwide license to use, modify, distribute, display and otherwise exploit that User Content for any purpose, including commercial purposes, without compensation.

You represent and warrant that you have all necessary rights to submit User Content and that such content does not infringe third-party rights or violate applicable laws.

Zelus may remove User Content at its discretion and does not endorse or assume liability for User Content posted by users.

You must not upload or distribute content that is unlawful, abusive, defamatory, hateful, obscene, misleading, infringing, disruptive, or otherwise objectionable, or that interferes with the operation or security of the Platform.

Feedback and Ideas

Any comments, feedback or ideas you submit to Zelus are provided on a non-confidential basis. You grant Zelus a perpetual, worldwide right to use such submissions for any purpose without compensation or acknowledgement.

If you believe your copyrighted work has been infringed on the Platform, you should consult a legal advisor before submitting a claim. To submit a notice, you must provide all required information under applicable law, including identification of the copyrighted work and the allegedly infringing material.

The Platform may link to or integrate with third-party websites, apps or services. Zelus does not control or endorse these third parties and is not responsible for their content, policies or practices. Your interactions with third parties are at your own risk and subject to their terms.

Disclaimers

To the maximum extent permitted by law, Zelus is not responsible for any injuries, damages or losses resulting from your use of or inability to use the Platform.

The Platform and all content are provided “as is” without warranties of any kind. Zelus disclaims all express and implied warranties, including warranties of merchantability, fitness for a particular purpose and non-infringement, to the extent permitted by law.

Zelus does not guarantee uninterrupted or error-free operation of the Platform or that defects will be corrected.

Termination

Zelus may suspend, modify or terminate the Platform or your access to it at any time without notice, subject to applicable law. These Terms remain effective even after you stop using the Platform.

Indemnification and Limitation of Liability

You agree to indemnify and hold harmless Zelus, its affiliates and partners from any claims, losses, damages or expenses arising from your use of the Platform, your User Content or your violation of these Terms.

To the maximum extent permitted by law, Zelus will not be liable for indirect, incidental, special or consequential damages. Zelus’ total liability will not exceed US$100.00 or €100.00 where required by applicable law.

Governing Law and Jurisdiction

Unless otherwise required by applicable local law, these Terms and any disputes arising from them are governed by the laws of England and Wales. Disputes shall be resolved exclusively in the courts of England and Wales.

Electronic Communications

By using the Platform, you consent to receive electronic communications from Zelus and agree that such communications satisfy legal requirements for written notice.

Assignment, Waivers and Severability

Zelus may assign its rights and obligations under these Terms at any time, subject to applicable law. Failure to enforce any provision is not a waiver of rights. If any provision is found unenforceable, the remaining provisions will remain in effect.
